Service Agreement
1. Provider
The Get Media-Ready for Good course (“Course”) is provided by Lua Morena Unipessoal Lda, trading as Eddie Staltari Media (“Provider”, “we”, “us”, “our”).
2. Scope of Services
The Course is a digital training program focused on media advocacy, communications, and public relations.
It provides:
- Educational content
- Strategic guidance
- Tools, frameworks, and insights.
The Course does not include:
- Done-for-you PR services
- Media outreach or placement
- Representation to media outlets.Â
3. Nature of the Service and No Guarantee of Results
The Provider will deliver the Course with reasonable skill and care.
However, we do not guarantee any specific results, including:
- Media coverage
- Press features
- Business or reputational outcomes
Results depend on factors beyond our control, including editorial decisions, timing, and external events.
4. Participant Responsibility
You are solely responsible for:
- How you apply the Course content
- Your decisions, actions, and results
- Any public exposure resulting from media engagement.
You acknowledge that engaging with media may involve risks, including public scrutiny and negative feedback.
5. No Professional Advice
The Course is for educational purposes only and does not constitute:
- Legal advice
- Crisis communications services
- Professional PR representation.
6. Intellectual Property
All Course materials are the intellectual property of the Provider.
You are granted a limited, non-exclusive, non-transferable license for personal or internal business use only.
You may not:
- Copy, reproduce, or distribute materials
- Share access with third parties
- Use materials to create competing products or services.
7. Acceptable Conduct
You agree to participate respectfully in all Course-related interactions.
We reserve the right to suspend or terminate access in cases of serious misconduct.
8. Limitation of Liability
To the fullest extent permitted by law, the Provider shall not be liable for:
- Indirect or consequential losses
- Loss of income, profits, or opportunities
- Reputational damage.
Nothing in this Agreement excludes or limits liability for:
- Fraud or fraudulent misrepresentation
- Gross negligence
- Any liability that cannot be excluded under applicable law.
9. Indemnity
You agree to indemnify the Provider for claims arising from:
- Your breach of this Agreement
- Misuse of the Course content
- Unlawful or harmful actions attributable to you.
This clause applies primarily in business or professional contexts.
10. Fees and Payment
Full payment is required before access is granted.
If payment fails, access will not be provided.
11. Right of Withdrawal (Consumers Only)
If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with applicable consumer law.
Loss of Right of Withdrawal
You expressly agree that:
- The Course is digital content delivered immediately upon purchase
- Access begins immediately after payment.
By providing your prior express consent and acknowledgment at checkout, you understand that you lose your 14-day right of withdrawal once access to the Course has begun
12. Refund Policy
Consumers (B2C)
Once the right of withdrawal has been validly waived and access granted:
- Refunds are not provided unless required by law
- This includes cases of defective or non-conforming content
Businesses (B2B)
- All sales are final unless otherwise agreed in writing
Nothing in this section affects your statutory rights.
13. Digital Content Conformity
Under applicable EU law, the Provider ensures that the digital content:
- Matches its description
- Is functional and accessible.
If the content is not in conformity, you may be entitled to:
- Correction
- Price reduction
- Termination of the contract (where applicable).
14. Governing Law and Jurisdiction
This Agreement is governed by the laws of Portugal.
Consumers
If you are a consumer, you may also benefit from mandatory protections and jurisdiction in your country of residence.
Businesses
For business users, disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.
15. International Users
If you access the Course outside Portugal, you are responsible for complying with applicable local laws.
16. Acceptance
By enrolling in the Course, you confirm that:
- You have read and understood this Agreement
- You agree to be bound by its terms
- You have provided any required consent for immediate access to digital content.
